I like the top shot best, but you need to crop out that branch on the left. It intrudes into the scene.

I agree with swmdrayfan about the first one being better. The bird tends to get lost in the water in the second picture. This may be addressable with a narrower DOF or using some selective filtering on the BW conversion. I also find the bird in the background (right behind the foreground birds head) somewhat distracting.

in the second picture, IMO the birth in the water make it look like the other one is trying to get attention extending the wings, "showing off for the lady".
