Release in event application...

Every year our bicycle club puts on a supported ride of 12-100 miles for riders from families with small kids to local racers. We take photos and use them to promote the event and the club - mostly on our own web site. The application that they have to sign (and parent or guardian for those under 18) has the usual, 'you will not hold us responsible, etc.' paragraph. What are the thoughts about also including the photo release in this paragraph? Would that be sufficient? TIA. TF

I think so, if you're going to use the photos it ought to be in there.

Well your 'you will not hold....' indemnifies the club and is a term or condition.

The photo release is about privacy. Depending on your state's model release requirements, if the participant is not compensated in some tangible way a photo release statement could well be invalid.

Sorry, I don't understand. Are you saying that a separate signature would be required and/or that compensation is required for any realease? Here is the IL Right of Publicity Act:

In California if the model is not compensated with something of value, like money, you don't have a valid model release.

What I'm trying to say is what consitutes a valid release in California (or some other state) probably won't be valid in IL, each state has it's own requirements.

The U of ILL's form is very basic and specific to use by the University and it's Foundation.

I would recommend the bike club check with a local attorney.

I see no reason why including it in the application wouldn't work.

btw - One of the first parts of 'Model Release' is why not to consult a lawyer.
