Can You Refuse Treatment Under the Baker Act?

If someone is placed under the Baker Act, do they have any legal rights to refuse treatment? I’m worried that if someone is wrongly admitted, they might not be able to get out, even if they don’t actually need help.

Re: Can You Refuse Treatment Under the Baker Act?

Yes, individuals placed under the https://unitedrecoveryproject.com/rehab-blog/baker-act/ do have rights, including the ability to challenge their detention. The initial hold is typically for 72 hours, during which a medical evaluation is conducted. If professionals determine that continued treatment is necessary, the person may be required to stay longer. However, they have the right to legal representation and can petition for release if they believe they were wrongfully admitted. Understanding the legal aspects of this law can help individuals and their families navigate the process more effectively.
