    The program itself looks like it could be a lot of fun to try, but its online and you cant keep a file of your image in the free plan, which would be $10 a month.. also your images are not private and aviary has the right to use them in advertising.... that's a deal breaker right there...

    If you can't keep a file, not sure what good it is. So it isn't really free, they're just letting you see and play w/ it before buying.

    I think what they might mean by the right to use them in advertising is to show what Aviary users have done with the program. That's not too bad. However, I wonder if they also claim all rights, or at least duel usage rights (you and they own it) forever? Nobody should accept that sort of deal. I'll have to read their agreement closely

    Hi there,

    I'm one of the co-founders of Aviary and can answer the question about our Terms and use in advertising. It's exactly what you thought - we'd use it in a promotion showing how users are using Aviary to advertise Aviary itself. We wouldn't use it or authorize it for a third party software. It's a lot like how Apple will show commercials for the iphone and feature apps from the app store in it.

    We do not claim all rights or duel usage rights. You own your work in its entirety.

    I spent a lot of time summarizing the Terms here (http://www.aviary.com/terms), which will hopefully make things clearer, but if not I am happy to answer questions at avi@aviary.com (and I'll try to check back in here anyway - looks like a great site!)

    So rest assured you can definitely keep and download your work and YOU own it.
